APPLICATION AND RESEARCH CENTER REGULATION

 

PART ONE
Purpose, Scope, Basis and Definitions

Purpose
ARTICLE 1 – (1) The purpose of this Regulation is to establish the procedures and principles regarding the purposes, activities, management bodies, and duties of the management bodies of the Istanbul Sabahattin Zaim University International Islamic Economics and Finance Application and Research Center, established under the Rectorate of Istanbul Sabahattin Zaim University.

Scope
ARTICLE 2 – (1) This Regulation covers the provisions regarding the purposes, activities, management bodies, the duties of the management bodies, and the working procedures of the Istanbul Sabahattin Zaim University International Islamic Economics and Finance Application and Research Center.

Legal Basis
ARTICLE 3 – (1) This Regulation has been prepared on the basis of sub-clause (2) of paragraph (d) of the first paragraph of Article 7, and Article 14, of the Higher Education Law No. 2547 dated 4/11/1981.

Definitions
ARTICLE 4 – (1) As used in this Regulation;

a) Advisory Board: The Center's Advisory Board,
b) Center: The Istanbul Sabahattin Zaim University International Islamic Economics and Finance Application and Research Center,
c) Director: The Director of the Center,
ç) Project groups: The Center's project groups,
d) Rector: The Rector of Istanbul Sabahattin Zaim University,
e) University: Istanbul Sabahattin Zaim University,
f) Board of Directors: The Center's Board of Directors,

shall have the meanings set out above.

PART TWO
Purpose and Fields of Activity of the Center

Purpose of the Center
ARTICLE 5 – (1) The purpose of the Center is to conduct theoretical and applied research on Islamic economics and finance, economic institutions in Islamic civilization, interest-free banking, insurance, money and capital markets, commodity markets, and derivative markets; to scientifically examine and interpret economic and social developments, structural problems, and opportunities; to produce new knowledge in these fields through an interdisciplinary approach and to develop application models for this purpose; and to contribute to the development of the University's cooperation with the public sector, private sector, civil society organizations, and international organizations by organizing continuing programs in all fields outside the academic programs in which the University provides education and conducts research.

Fields of activity of the Center
ARTICLE 6 – (1) In line with the purposes specified in Article 5 of this Regulation, the Center engages in activities in the following areas:

a) To analyze and evaluate information obtained from domestic and international scientific publications, to convey the knowledge produced, national and international scientific meetings, and publications to relevant parties and the public, to update course materials and make them available for similar purposes, and to ensure the development of a research archive,
b) To conduct research on Islamic economics and interest-free banking at local, regional, national, and international levels,
c) To produce projects at local, regional, national, and international levels,
ç) To conduct comparative studies with conventional economics,
d) To organize studies in the fields of Islamic economics and finance,
e) To conduct research on economic institutions in Islamic civilization,
f) To develop Islamic financial products and conduct studies on interest-free banking, insurance, capital markets, commodity markets, and derivative markets,
g) To produce joint projects together with public and private sector institutions and organizations related to the subject,
ğ) To research opportunities for cooperation with other national and international organizations working on the subject and to ensure joint work is carried out, and to make research results available to public and private sector institutions, organizations, and researchers,
h) To ensure cooperation with scientists interested in the Center's fields of work,
ı) To cooperate with other institutions and research centers, when necessary during implementation, in preparing projects,
i) To publish periodic and non-periodic publications related to the field of work, and to organize conferences, seminars, and similar scientific meetings,
j) To carry out studies on other subjects to be determined by the Rector.

PART THREE
Governing Bodies of the Center, Project Groups and Their Duties

Governing bodies of the Center
ARTICLE 7 – (1) The governing bodies of the Center are as follows;

a) Director,
b) Board of Directors,
c) Advisory Board.

Director and duties
ARTICLE 8 – (1) The Director is appointed by the Rector for a term of three years from among the University's salaried faculty members who have research and application experience. A Director whose term has ended may be reappointed under the same procedure. If necessary, the Director may be removed from office by the Rector before the term expires.

(2) The Director selects up to two people from among the Board of Directors members as deputy directors to assist in their work. Deputy directors are assigned by the Director for a maximum of three years. When the Director's term ends, the deputy directors' terms end automatically. When the Director is not present, one of the deputies acts on the Director's behalf. If the acting term exceeds six months, a new Director is assigned by the same procedure.

(3) The duties of the Director are as follows;

a) To call the Board of Directors and Advisory Board to meetings, prepare their agendas, chair their meetings, and implement Board of Directors decisions,
b) To make administrative arrangements and carry out administrative and technical affairs in order to achieve the Center's purposes specified in this Regulation,
c) To prepare the previous year's activity report and the next year's work program regarding the Center's activities, in line with the opinion of the Board of Directors,
ç) To report to the Rector on the general status and functioning of the Center at the end of each year and when requested,
d) To determine, with justification, the appropriation and staffing needs according to the annual plan and program, and to submit them to the Board of Directors,
e) To represent the Center,
f) Performing the duties of spending authority in the event of delegation of authority by the Rector.

Board of directors and duties
ARTICLE 9 – (1) The Board of Directors consists of seven people, including the Director. The other six members are appointed by the Rector for a term of three years from among University faculty members who have national and international work experience. A member whose term has ended may be reappointed under the same procedure. Should a Board member leave office before the end of the term, a new member is appointed under the same procedure to complete the remaining term.

(2) The Board of Directors normally meets once a month. The Director may call the Board of Directors to an extraordinary meeting when deemed necessary. The Board of Directors convenes with an absolute majority of the total number of members, and decisions are taken by majority vote. In the event of a tie, the majority is deemed to have been achieved in the direction of the vote cast by the Director.

(3) The duties of the Board of Directors are as follows:

a) To make decisions regarding the management and activities of the Center,
b) To discuss and decide on proposals from the Director and Board of Directors members,
c) To make decisions on the establishment, naming, determination of working principles, and termination of project groups and similar sub-units,
ç) To prepare the principles related to the Center to be discussed and adopted by the Senate,
d) To determine the principles of cooperation for joint work to be carried out with national and international institutions and organizations, and to examine the prepared protocols and give an opinion,
e) Examining the annual work program and budget, obtaining the opinions of the Advisory Board and other relevant parties, ensuring that new program and budget arrangements are made, and that these are submitted to the Rectorate in a timely manner.

Advisory board and duties
ARTICLE 10 – (1) The Advisory Board consists of at least seven members, appointed for a term of three years upon the proposal of the Board of Directors or directly by the Rector, comprising University faculty members; representatives designated, upon request, by real and legal persons with theoretical and applied work in all relevant fields; and one member each proposed by civil society organizations whose purpose and activities relate to economic, social, and technical development. Members whose term has ended may be reappointed.

(2) The Advisory Board normally meets once a year at the invitation of, and under the chairmanship of, the Director. The Director may call the Advisory Board to an extraordinary meeting when deemed necessary. Within the scope of the agenda prepared by the Director, the Advisory Board takes advisory decisions consistent with the Center's purposes and provides opinions and recommendations regarding the Center's activities.

Project groups and duties
ARTICLE 11 – (1) Project groups are established by decision of the Board of Directors to carry out the Center's work. The establishment of project groups, their working procedures and principles, and the coordination and cooperation among project groups are determined by the Board of Directors. Project groups submit status reports on their projects to the Board of Directors at intervals to be determined according to the project duration. The status reports of project groups are discussed by the Board of Directors. Based on the status reports, projects may be terminated with justification before their term ends, or merged with another ongoing project.

(2) Project groups are formed with a sufficient number of experts suited to the project's subject matter. Experts from other institutions and organizations may be assigned to project groups in accordance with the relevant legislation. The project manager is the owner of the project. The distribution of tasks for the project is made by the project manager. Any problems arising in connection with the project are resolved by the project manager. Problems not resolved by the project manager are resolved by the Director, and if deemed necessary, placed on the agenda of the Board of Directors and decided upon.

PART FOUR
Miscellaneous and Final Provisions

Personnel requirements
ARTICLE 12 – (1) The Center's academic, technical, and administrative personnel needs are met by staff employed at the University and assigned by the Rector in accordance with Article 13 of Law No. 2547.

Financial provisions
ARTICLE 13 – (1) The Center's budget is submitted by the Rector to the Board of Trustees after being discussed at the University Board of Directors. It becomes final after approval by the Board of Trustees.

(2) The Center's revenues are: shares allocated from the University budget, donations and grants made to the Center, revenues obtained from projects, courses, report preparation, publications and research, and other revenues.

(3) The Center's expenses are: all kinds of equipment used at the Center, maintenance and repair, publication and research expenses, personnel salaries, payments made to trainers, awards given to students taking part in projects, and expenses for scientific meetings, panels, courses, seminars, and similar activities.

(4) If income exceeds expenses, the resulting surplus is transferred to the following year's budget, by decision of the Board of Trustees, to be used for scientific research.

Fixed assets
ARTICLE 14 – (1) All kinds of tools, equipment, and fixed assets acquired within the scope of research supported by the Center are allocated for the use of the Center and, when necessary, the University.

Authorizing officer
ARTICLE 15 – (1) The spending authority of the Center is the Rector. The Rector may delegate this authority to the Director.

Cases not provided for in this Regulation
ARTICLE 16 – (1) In cases not provided for in this Regulation, the provisions of Law No. 2547 and other relevant legislation shall apply.

Entry into force
ARTICLE 17 – (1) This Regulation shall enter into force on the date of its publication.

Execution
ARTICLE 18 – (1) The provisions of this Regulation shall be executed by the Rector of Istanbul Sabahattin Zaim University.
