Course Objective
The aim of the course is to teach Islamic Economics and Finance Students how to follow the rules of empowerment and give information about Islamic law sources. It is to teach the methods of making of law which the researcher should follow in bringing solutions to new problems.
Course Content
The definition and the kanun of Islamic jurisprudence, the sources of Islamic law, the proofs that the sects regard as the second source, the shari'a and vad'i verdicts, the judgments from the sources, the manifestation, the qualifications of the taxpayers.
Course Learning Outcomes
- Çıkan sorunların islam hukuk metodolojiyle çözümü yeteneği gelişir.
- Hz. Peygamber’in söz, fiil ve takrirleri, fiziksel ve ahlaki özellikleri, hadisin ve hadis ilminin tarihi seyri, usulü, problemleri, yorumlanması ve kültürel değeri hakkında bilgi sahibidir.
- İslam hukuk siteminde ehliyet, kişi ve hukuki işlem yetenekleri hakkında bilgi sahibi olur.
- İslam hukukda hüküm çıkarma yöntemleri mezhep imamların ve sonraki dönemdeki yaklaşımlardaki gelişmelere vakıf olur
- İttifak edilen İslam hukuku kaynakları, bunların dışında mezheplerin farklı hukuk kaynakları hakkında bilgi sahibi olur
- Klasik kaynaklarda ve modern araştırmalarda İslam fıkhının temel konularını bilir; mukayeseli hukuk yöntemleri çerçevesinde İslam hukuku ile diğer hukuk sistemleri arasında karşılaştırmalar yapabilir ve İslam hukukunu hukuk tarihi açısından değerle
- Kur’an-ı Kerim’i usulüne uygun okuyabilir ve metnin amacına uygun yorum yapabilir.
