Course Objective
The broad aims of this course are twofold: first, is to consider the significant restraints that defamation law and associated causes of action place on what can be published by the media; and second, is to consider whether the extent and scope of such restraints are appropriate. These aims are pursued through a detailed comparative analysis of defamation law in Turkey, as well as by looking at many of the practical aspects of defamation law that contribute to its impact on media freedom in the EU under the decisions of the European Court of Human Rights. Particular focus is placed on questioning the appropriate balance between the protection of personal rights and the media’s perceived role in a democratic society as both ‘watchdog’ and ‘bloodhound’.
Course Content
The role of the state and the nature and basis of civil liberties in law. Remedies and procedures for protecting rights and freedoms, including challenges to delegated legislation, judicial review and the role of recent high court decisions. The impact of international and European human rights law. Civil defamation, Criminal defamation, Religious defamation, Freedom of speech; defamation; blasphemy; obscene libel; contempt of court; defences and remedies.

Course Learning Outcomes
- At the succesful completion of this course students will be able to comment on major issues of defamation and the media in accordance with the national and international current developments.
- Students will do research in the field of personal rights, defamation law and the media law, comment on current issues while analyzing their legal knowledge gained through this course.
