Course Objective

The purpose of the course is to provide the post-graduate student with the foundational knowledge of education and administrative law in order to serve as an effective head teacher and educational leader in Ministry of National Education.

Course Content

Education and Administrative Law is a vital subject for the education administrators. An understanding of the role which it plays is essential to school directors. Head teachers frequently come into contact with regulatory agencies whose special procedures derive from administrative law. Dealings with internal and international agencies (including the European Union) are often governed by administrative law. Public law expertise opens the way to good careers in government service. The course aims to reflect the wider dimensions of education and administrative law, stressing links with public administration, virtue and merit. This course emphasises the functions of law in the education and administrative process. It also aims to show how the right to education in the 1982 Constitution and in the European Convention on Human Rights has influenced our system of administrative law. This course looks at the way in which changed systems of governance, especially the rapid growth of regulatory agencies, can be reflected in and controlled by traditional rules of administrative law. We consider alternative dispute resolution, including the Ombudsman Institution. In addition to compulsory essays there are opportunities for presentation of papers.

Course Learning Outcomes

  1. Upon successful completion of the course, the student will recognize the place and characteristics of the education law and the higher education law in the legal system in comparison with other countries.
  2. The student will be able to recognize and question the responsibilities of the education administrators according to national and international legal texts in providing the right to education. He will improve his analysis ability with case examples.
  3. The student will have knowledge of legal regulations and procedures in educational institutions and will understand and discuss the importance and place of administrative law in educational institutions.
  4. The student will understand the basic problems specific to the field of education and higher education and will be able to question this issue with a specific perspective and will know the institutions, the subjects and their relations with each other
  5. Educational administrators will examine the following sub-headings related to administrative law (general qualifications of management, administrative organizations, public officials, public goods, management of administration, supervision of administration) through legal texts and court decisions.
