Course Objective

It is aimed to convey the important role of constitutional jurisdiction that protects fundamental rights and freedoms and put the supremacy and binding force of constitutions into practice. By this way, the importance of constitutional review for the principles of rule of law and democratic state will appear. Also, it is aimed to have a competence of analyzing the decisions, working principles of constitutional courts in national and comparative law.

Course Content

Legitimacy, meaning and function of Constitutional jurisdiction, duties and powers of Constitutional Courts, norm control, Subject, time and criterion of Constitutional jurisdiction, Legal consequences of Constitutional Court decisions, Decision to stop enforcement in Constitutional jurisdiction, Direct application of Constitutional rules

Course Learning Outcomes

  1. To be able to render the development of constitutional review and the legal arguments providing constitutional review
  2. To be able to express the importance of constitutional courts
  3. To be able to remark the role of constitutional jurisdiction in protection of the fundamental rights regarding both national and comparative constitutional systems
  4. To be able to internalize the system of constitutional jurisdiction; the range, types of constitutional review and efficiency and binding force of decisions
