Course Objective

The objectives of this course are to:

  1. To provide students with the knowledge of stages that Islamic Legal Maxims  (Qawa’id Fiqhiyah), regulations (Dhawabit) and Furu’ (branches) and the way they developed in Islam.
  2. To provide the students  with the  knowledge of the way these Legal Maxims should be applied in our contemporary time.
  3. To enable the students to understand the importance and sources of these Legal Maxims and their roles in Banking and Finance.

Course Content

This course: Qawa’id Fiqhiyah (Islamic Legal Maxims) is planned to equip students with the knowledge about the rules, regulations, norms and as well as the theories of Shari’ah with regards to Mu’amalat (transactions) in general and Islamic Economics and Finance in particular. The course also includes discussions on the history of development of Islamic Legal Maxims which are either extracted from Traditions of Prophet (saw) or from general rulings of Shari’ah.

Course Learning Outcomes

  1. 1. Demonstrate the knowledge of History and development of Islamic Legal Maxims (Qawa’id Fiqhiyah).
  2. 2. To know the major sources of Islamic Legal Maxims and the way they are used induction of Shari’ah rulings.
  3. 3. Demonstrate the knowledge of practical aspects of these Legal Maxims especially in the area of Islamic Economics and Finance in our contemporary time.
